Binding Arbitration
Arbitration Agreement
To the maximum extent permitted by applicable law, you agree that any dispute, claim, or controversy between you and Sense & Edibility®, or our vendors or service providers, arising out of or relating in any way to your access to or use of the Website, these Terms, or your relationship with us will be resolved through binding arbitration rather than in court, except that:
- You may assert qualifying claims in small claims court, provided that the matter remains in that court and proceeds only on an individual, non-class, and non-representative basis; and
- You or Sense & Edibility® may seek equitable relief in court for infringement or other misuse of intellectual property rights, including copyrights, trademarks, trade dress, trade secrets, domain names, and patents.
You agree that any arbitration or other claim must be commenced within one (1) year after the dispute arises, unless a longer period is required by applicable law. Otherwise, the claim will be permanently barred to the fullest extent permitted by law.
You agree that claims subject to this Arbitration Agreement will be brought only on an individual basis and not as a class, collective, or representative action, except to the extent applicable law does not permit such a waiver.
The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.
Before commencing arbitration, you must first provide written notice describing the dispute and requested relief and give us an opportunity to attempt to resolve the matter informally.

If the matter cannot be resolved informally within thirty (30) days, either party may commence arbitration through JAMS in accordance with its applicable rules.
You and Sense & Edibility® waive the right to a trial by jury for disputes subject to this Arbitration Agreement.
The arbitrator, rather than a federal, state, or local court, will have authority to determine the enforceability, interpretation, and application of this Arbitration Agreement, except where applicable law provides otherwise.
If any portion of this Arbitration Agreement is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
This Arbitration Agreement survives termination of your use of the Website or your relationship with Sense & Edibility®.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENSE & EDIBILITY®, ITS OWNER, AFFILIATES, VENDORS, SERVICE PROVIDERS, ADVERTISING PARTNERS, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE WEBSITE OR ITS CONTENT.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
Changes to These Terms
